Senior Citizen Poker Game Busted

Everyone thinks that senior citizens are harmless, quiet, and law abiding. Well, it is time we think again, at least for one group of senior citizens. A group of senior citizens living in an Idaho Senior Center in Twin Falls were told by police recently that the $20 buy-in poker game they held every now and then was illegal and that they were breaking the law. It is a small group of residents, roughly 20, who take part in the regular game. Police told the residents that if they did not stop playing the game they would be subject to prosecution.

Most of the seniors are in their 70s and 80s and did not realize that playing poker for money in the state of Idaho was against the law. They begrudgingly decided to stop playing their tournament but were not too happy about the decision said resident Norman Pohl:

“I don’t have many things that I can do. I met so many people…I would look for it every week.”

The residents are still playing poker at the senior center but have been doing so without money being present, which has taken away their fun since there is nothing at stake anymore. Idaho defines illegal gambling as the following:

“Risking any money, credit, deposit or other thing of value for gain contingent in whole or in part upon lot, chance, the operation of a gambling device or the happening or outcome of an event, including a sporting event, the operation of casino gambling including, but not limited to, blackjack, craps, roulette, poker, baccarat or keno.”

The poker game at the senior center had been running for five years prior to an anonymous tip being sent to authorities. The more stringent of the laws is that any prosecutor can be charged with a misdemeanor if he or she did not prosecute or investigate a report of illegal gambling. This is what forced authorities in the state to break up the game. Grant Loebs, Twin Falls County Prosecutor, had the following to say:

“It is a misdemeanor crime for a prosecutor to fail to prosecute someone who fills out an NCAA tournament bracket. That seems, at best, to be a waste of law enforcement resources.”

This law dates back to when Idaho was still a territory of the United States, which caused state politicians to change the law. Prosecutors would now have discretion as to which cases they investigate and prosecute.
